Judge changes mind on appeal against murder conviction

Johannesburg High Court Judge Neels Claassen last week set aside an order he had previously made preventing Magistrate Mxolisi Matereke, jailed for murdering his best friend five years ago, from seeking to appeal against his conviction and sentence.

Matereke (46) is serving a 10-year sentence for killing Vika Ngcobo in August 2002, says the Sowetan. After his conviction Matereke brought several unsuccessful applications to appeal against his conviction and sentence. But Claassen, in reversing his previous decision, said that at the time he had been unaware of Matereke’s applications to other courts and ruled that all Matereke’s applications be brought under one court.
