Gap brand issue back in court

Clothing of US brand Gap International remains on the shelves in select Stuttafords branches while the court battle over who owns the Gap brand name in SA continues in the Pretoria High Court today.

A Business Day report says that last month, KwaZulu-Natal clothing company Kingsgate won an interim interdict against Stuttafords and US-based Gap International that required them to stop selling the clothing line until the ownership issue was resolved. Kingsgate claims it owns the Gap brand name, registered separately in SA, since 1971. However, before a final order could be handed down, Stuttafords and Gap applied for leave to appeal against the interim order, and also an application for Judge Basson to recuse himself.
