Farmer gets writs to attach Absa property

Absa bank has been issued with three writs that permitted the Sheriff of the Pretoria High Court to attach up to R32m worth of moveable property from its head office in central Johannesburg.
The Weekender reports that the order is just the tip of the iceberg of a bitter dispute between Swazi farmer Dumisa Dlamini and the bank, in which Dlamini claims that he was defrauded. He claims that despite Absa owing him about R167m in cash plus interest, it had foreclosed on properties bonded to the bank for amounts totalling R13m. GM for Absas litigation and disputes team, Glenn Cooper, has responded, however, by saying: neither Dlamini nor his company has ever obtained any judgments against Absa. On a previous occasion, and in the absence of any judgments against Absa, Dlamini succeeded in getting writs of execution issued and served on Absa. Absa, on that occasion, succeeded in having those writs set aside by the High Court. Dlamini has again succeeded in having further writs of execution issued against Absa. Absa is investigating how it is possible that the Registrar of the High Court could have issued the writs of execution in the light of the history of the matter and in the absence of any judgments.
