Action is limited to lien – US Court

The US Appeals Court for the Eleventh Circuit reaffirmed a 19th Century principle that any action against a vessel to enforce a maritime lien is limited to the value of the lien itself and serves no other purpose.

In its ruling, the court said a salvage company could not recover its legal costs as part of a salvage lien, reports The Business Times. The vessel that was salvaged was the luxury motor yacht M/V MR23. The yacht grounded in the Bahamas in July 2002. The legal action was brought by Offshore Marine Towing (OMT) which disputed the salvage payment due to it from the yacht owner. Full report in The Business Times
