Legislation: New data bundle regulations clarified

Publish date: 06 March 2019
Issue Number: 1771
Diary: Legalbrief eLaw

The Independent Communications Authority of SA (Icasa) has confirmed that the amended out-of-bundle data regulations in force from 1 March do provide for ‘the transfer and rollover of unused data before expiry’, notes Pam Saxby for Legalbrief Policy Watch.

According to Friday’s media statement, ‘defaulting an end-user onto out-of-bundle charges upon depletion of (a) data bundle’ is also prohibited – although service providers have until 12 April to adapt their systems so that the required usage depletion notifications can be sent to consumers wishing to receive them. The ‘spirit and intention’ of the amendments are therefore ‘retained’ despite the postponement of certain of their provisions.
