Law firm guilty of negligence, liable for damages

A respected Zambian legal firm has been found professionally negligent by filing a defective appeal record. This finding comes after the country’s apex courts held that because the appeal record was defective the appeal should be dismissed, without any ventilation of the merits. Now, as Carmel Rickard explains, in subsequent litigation, the High Court has found the firm professionally negligent. A major consequence was that the court also held the firm liable for damages by way of the legal fees involved in the case and even for an as-yet to be assessed part of the multi-million Zambian kwacha sum at the heart of the original dispute.
