Interest in arbitration in Zambia has grown significantly in recent decades due in large measure to the enactment of the Arbitration Act No19 of 2000 as well as the surge and congestion in state courts of commercial and other disputes. Being a flexible and consensual process, arbitration has proven to be a suitable alternative to court litigation and is now one of the most preferred methods of resolving commercial disputes in Zambia. Handbook on Arbitration in Zambia is the first comprehensive exposition of the practice and procedure of arbitration in Zambia. It provides a historical overview of arbitration in Zambia, highlighting activities undertaken by various stakeholders in popularising the use of arbitration as a dispute resolution mechanism. A brief outline of the concept of arbitration is also included, setting out its benefits and drawbacks and the key steps of the arbitral process. The book also contains a section-by-section commentary on the Zambian Arbitration Act which guides the reader on the procedures governing arbitration in Zambia and illustrates them with examples drawn from decided cases emanating from the country’s superior courts. Handbook on Arbitration in Zambia is intended to serve as a suitable reference material to assist students, the bench, and legal practitioners, in better understanding the arbitral process in general and the Arbitration Act No 19 of 2000.
