Draft picketing regulations out for comment

In anticipation of the commencement of the 2017 Labour Relations Amendment Bill, draft picketing regulations have been gazetted for comment by 28 September, reports Pam Saxby for Legalbrief Policy Watch. The Bill was sent to President Cyril Ramaphosa last month for signature, along with the 2017 Basic Conditions of Employment Amendment Bill and the National Minimum Wage Bill. Once in force, the proposed new regulations will give practical effect to provisions in the Labour Relations Amendment Bill for picketing by collective agreement or in accordance with a CCMA determination. This is noting clause 3.4.2 of the National Economic Development and Labour Council declaration on wage inequality and labour market stability, which requires the Act to be amended to provide for ‘default picketing rules’ where no agreement has been reached by the parties concerned.
