Two judges to testify in case of alleged forged order
Two KZN judges will soon be in the witness box in a trial dealing with the alleged forgery of High Court orders.
Judges Sharmaine Balton and Trevor Goven will testify in the KZN High Court (Durban) following claims by businessman Ian Brakspear that a liquidation order, which led to the sale of his farm, had been forged, notes a report in The Times. The order Brakspear claims was forged was issued in December 2008. He wants the order, used as the basis for the liquidation of Brakspear's West Dunes Properties, which owned the farm, set aside. KZN Judge President Chiman Patel ruled that a judge from another division would hear the trial. 'It is not often that judges give evidence, but extravagant allegations have been made about the judiciary,' said Patel. Balton signed the provisional liquidation order and Goven signed the final order. Full report in The Times
