Sodomy defence in ET killing - lawyer

A lawyer acting for one of the farm workers accused of killing Eugene Terre'Blanche claims the AWB leader tried to sodomise his client, says a Sunday Times report.

'My instructions from my client are that there was some sodomy going on and it sparked the murder of Mr Terre'Blanche. This is going to form part of our defence,' said Puna Moroko, attorney for 28-year-old Chris Mahlangu. Mahlangu's co-accused is a 15-year-old boy. Moroko also claimed that Terre'Blanche first tried to get the accused drunk before he allegedly tried to have sex with 'one or both of them'. 'It is in the court record that Mr Terre'Blanche bought my client 18 Savannas (cider) and the other accused, who is still a minor, 13 Savannas before driving them to his farm. Mr Terre'Blanche bought himself a bottle of Smirnoff (vodka) at the same liquor store.' Attorney Zola Majavu, acting for the teenager, told the paper: 'I have consulted with my client and I am satisfied that something shocking happened on that day. I will disclose fully what my client told me happened during trial.' Majavu would not comment on the sexual allegations, but said his client 'has undergone all the necessary tests that I need to prove his case'. The AWB has reacted angrily to the claims. 'It is impossible,' a report in the Sunday Tribune quotes AWB secretary general Andre Visagie as saying. 'He told his wife he was coming home from the farm that night (to the family home in Ventersdorp). He wouldn't have taken a black man instead of a white woman.' Visagie said the AWB was adamant claims that its leader was homosexual would be proved false. 'He didn't like moffies at all.' Asked how he knew what Terre'Blanche's sexual preference was, Visagie said: 'Remember Jani Allen (the newspaper columnist who had an affair with him)? I don't think he was lying.' He said it was 'absurd' to suggest Terre'Blanche would try and stop his attackers by sodomising them. Besides, he added, two weeks before his murder the AWB leader had stents placed in his arteries, which meant his heart wouldn't have been up to it. Full Sunday Tribune report (subscription needed)

However, police have confirmed they are investigating whether there was a link between homosexual sex and the murder, says a report on the IoL site. 'We are not going to focus on one thing,' said Musa Zondi, of the Hawks investigative unit, adding that a sexual link was among the many accusations being made over the case. General Jan Mabula, head of the Hawks in the North West Province, told City Press newspaper the suspects' clothes were to be examined as part of checks into whether there was a sexual link.
