High Court overturns nose stud decision

Judge Dumile Kondile, of the Pietermaritzburg High Court, ruled the barring of a Durban student from wearing a nose stud was unfair and discriminatory, setting aside a decision of the Durban Equality Court.

The Equality Court had ruled that the school did not discriminate against the 15-year-old, and that the wearing of a nose stud violated the school\'s code. But, according to a report on the News24 site, yesterday Kondile said the Equality Court merely applied the school\'s code of conduct, disregarding the girl\'s religious and cultural rights. According to a report in The Mercury, Attorney Russell Sobey, who represented the school and its governing body, said he still needed to consult his clients, which was difficult because of the holidays, about what course to follow. Provincial Education Department spokesperson Nomonde Maboea said the department ‘respected the outcome of the judicial process.’
