CJ allows appeal against sentence of teenage killer

The State has been given the right by the Chief Justice to make another bid to imprison a Pietermaritzburg girl who was convicted of killing a 59-year-old relative when she was 12.

After the girl\'s conviction and sentence to a term of correctional supervision by High Court Judge Kevin Swain this year, the State filed an application to have her jailed instead of being left in the care of her mother. The girl is now 14. Two men strangled and stabbed to death Radha Govender at the request of the girl in September. 2002, says a Daily News report. The matter will now be argued on November 9 at the Supreme Court of Appeal. Advocate Sandesh Sanker, who prosecuted the girl during her trial, argued in the papers filed with the Chief Justice that Swain had ignored ‘compelling aggravating features’ in reaching his decision; among them that the girl had shown no remorse for her actions and had premeditated the planning and execution of the murder.
