Argument at CCMA over bid to subpoena NCOP head
A legal adviser to Parliament who was fired from her post, Advocate Lulama Matyolo-Dube, wants to subpoena the chairman of the National Council of Provinces (NCOP), Mninwa Mahlangu, to appear before the CCMA in an attempt to get her job back, or be paid out.
The Cape Times says it understands that Matyolo-Dube wants Mahlangu to answer questions surrounding her dismissal from the NCOP earlier this year. She applied for Mahlangu to be subpoenaed at the start of her arbitration hearing yesterday. However, says the report, this move was contested by a senior parliamentary legal adviser, who arrived at the CCMA offices and questioned senior commissioners about the motivation for hauling Mahlangu before the commission. The paper quotes a source as saying an argument ensued between the legal adviser and a senior commissioner, Nolukhanyo Madyibi, who is responsible for issuing subpoenas. 'She was arguing that a subpoena on Mahlangu was like inviting the President to speak to the hearing. But such decisions are taken according to the law,' said the source. The report says Parliament yesterday refused to comment or confirm whether the legal adviser was Advocate Zuraya Adhikarie. Full Cape Times report (subscription needed)
