Another Gautrain legal challenge

The Gautrain rapid rail link is facing another legal challenge barely a week after three residents of Marlboro settled with the provincial government about the expropriation of their properties, Five other families have made an urgent application to be heard in the Johannesburg High Court next week, says a Business Day report.

They are asking the court to review and set aside the decision of the Gauteng Roads and Transport MEC to expropriate three properties in Marlboro. They ask alternatively for dates appointed by the MEC for expropriation and taking possession of the properties to be declared unconstitutional and invalid. The families also want the court to interdict the MEC or his agents from disturbing the peace by conducting noisy building construction work at or near one of the premises. Full Business Day report
