South Africa Chocolates battle heading to top court
The trademark battle between Nestlé SA's KitKat and Break, a chocolate bar marketed by the International Foodstuffs Co, is heading to the Supreme Court of Appeal, Beeld reports.
Both companies have obtained leave to appeal from the North Gauteng High Court. That court rejected both companies' claims in December last year. Nestlé wanted an order prohibiting International Foodstuffs from using the two-finger and four-finger wafer forms. The company also alleges that the competitor's slogan, 'Take a Break', infringes its intellectual property 'Have a Break...Have a KitKat'. International Foodstuffs is seeking the scrapping of Nestlé's trademarks. Full Beeld report
