The arrest of two prominent Kenyan judges has caused widespread concern, locally and internationally. The two were arrested and taken in for questioning, allegedly in relation to investigations of bribery, and released after a couple of hours in the ongoing battle between the Bench and the executive arm of government in Kenya. In her A Matter of Justice column on the Legalbrief site, Carmel Rickard explains what happened, takes a look at the background as well as reaction to the arrests – and asks what special steps should be followed where police want to question, or arrest, a member of the judiciary in relation to allegations of a criminal offence.
