Moi, who remains Kenya's longest-serving leader, was accused by Chelugui and her son David of transferring their family land into his name two years after Noah died. The report notes that Moi was unable to provide the court with any evidence of how he came to possess the land. Ombwayo described Moi’s behaviour as 'unconstitutional, irregular, unprocedural and tainted'.
