‘Fishrot’ search warrant legal – judge

Publish date: 24 February 2020
Issue Number: 861
Diary: IBA Legalbrief Africa
Category: Namibia

An attempt by five of the men charged in Namibia’s Fishrot corruption case to have search and seizure warrants used by the Anti-Corruption Commission declared unlawful and set aside has been dismissed by the Windhoek High Court. The Namibian reports that Justice Thomas Masuku said the warrants were not ‘overbroad’ and sufficiently specified which officers were authorised to carry out the searches and seizures. As previously reported in Legalbrief Today, Icelandic fishing company Samherji is accused of paying kickbacks to Namibian politicians such as former disgraced Justice Minister Sacky Shanghala and Fisheries Minister Bernhard Esau. They are facing corruption and money laundering charges. The case was postponed to 23 April for further investigations to be carried out.
