Cabinet tells SABC to respect Motsoeneng ruling

The Cabinet has joined the ANC in Parliament, condemning its manoeuvrings to keep Hlaudi Motsoeneng on as a senior member of its executive team, notes Legalbrief. It has called on the SABC board to respect the ruling overturning his appointment as chief operations officer and slammed its bid to retain his services in a new post. Presidency Minister Jeff Radebe urged the board to respect ‘the letter and the spirit’ of the SCA’s refusal to allow an appeal and asked the Communications Minister to meet the board to ensure this happened. This, notes a report on the IoL site, comes a day after the board decided to re-appoint the controversial former COO in another position in a move that was swiftly slated by ANC Chief Whip Jackson Mthembu as ‘the last straw that breaks the camel’s back’. Mthembu also warned the board had to rescind the reappointment or face the wrath of Parliament. Radebe said Cabinet saw the board’s decision as disrespectful of the rule of law. ‘Attempts to subvert the SCA ruling through legally suspect interpretations border on violating the constitutional principle of legality and challenge the constitutionally assigned judicial authority of our courts,’ he quoted from the Cabinet statement. ‘The decision to re-appoint Mr Motsoeneng in a new position shows disrespect of a rule of law.'
