Lilongwe court orders review of transfer of judges

The High Court in Lilongwe has ordered a judicial review of the controversial transfer of Judges John Chirwa and Dingiswayo Madise from the Mzuzu District Registry to Blantyre. The Nyasa Times reports that Justice Charles Mkandawire said the court could not block the move but will allow for a judicial review to take place as a matter of urgency. The case was brought by businessman Leonard Chipeta, who is suing FDH Bank for defamation after being dismissed by the institution. Through law firm Jivason and company, he argues that the state, the Chief Justice and the Judicial Service Commission have breached the constitutional rights of citizens to receive justice because of the transfer of the judges. ‘My case has been ready for trial for some time, but due to the fact that there has been one judge at Mzuzu Registry, the file has never been allocated a date and there is no hope for its conclusion,’ Chipeta said, according to the report.
