Court overturns election commission's verdict

Kenyan politician Wavinya Ndeti’s name will be on the ballot for Kenya’s 8 August poll as the Wiper Democratic Movement’s nominee. This follows Judge George Odunga’s decision to set aside the Independent Electoral and Boundaries Commission (IEBC) verdict nullifying her nomination on grounds that she was still a member of the Chama Cha Uzalendo party. CapitalFM reports that the court found the commission’s verdict was ‘unreasonable’ but noted that its ruling would have been different had the IEBC based its resolution on the fact that Wavinya had entered into a coalition agreement on 24 April, weeks before the defection deadline. ‘The court has found that the issues raised as the basis for justification of the committee’s decision were not the grounds upon which the committee made its finding,’ Odunga ruled.
